The actress and the producer — who was recently spotted on romantic holiday with a new woman — also signed off on a parenting plan for their 10-year-old son Tennessee James.
The Legally Blonde star officially filed for divorce from Toth back in April, a week after announcing the end of their marriage. She cited irreconcilable differences as the reason behind their split in court documents.

Witherspoon and Toth’s divorce documents were filed in Nashville, Tennessee, where the couple lives with their son.
The documents reveal the couple agreed to a prenuptial agreement in March 2011.
Reese indicated the contract was valid, ‘providing “adequate and sufficient provisions” for their assets and debts,’ TMZ reported at the time of filing.
Reese noted she will turn over their prenuptial agreement and a permanent parenting plan for Tennessee for approval from the judge.
As the divorce was filed in Davidson County, Reese and her estranged husband will now have to take mandatory parenting classes. They have 60 days to present a certificate of completion to the court.
It comes amid reports that Toth has reportedly moved on from the star and was seen in Costa Rica enjoying a ‘romantic’ getaway with a mystery woman as per People.
Jim was staying with a new girlfriend at the Sendero Nosara in Costa Rica,’ the insider dished.
‘They seemed to be staying in a suite, and they looked really happy, just chilling and soaking up that pura vida vibe. It was definitely romantic.’
The divorce filing came a week after Reese and Jim announced their split on social media, just two days before their 12 year wedding anniversary.
A source has since provided some insight into their recent decision to end their marriage.

The insider told People that it was ‘very difficult’ for the movie star to accept that she and her former partner were ‘two very different people.’
Someone close to the two noted that the ambitious producer ‘has her hand in a lot of pots’ and Toth ‘prefers less frenzy.’
It was added that, ‘They’ve been spending less and less time together while she was working.’
More than ten years after tying the knot, the longtime duo recently ‘found themselves with fewer interests in common.’
Reese is described by a source as ‘headstrong and focused’ and Jim is said to be ‘more laid-back.’

Per Reese’s solemn divorce announcement shared last week, the twosome decided to go their separate ways with ‘a great deal of care and consideration.’
A source said the partners ‘worked on’ their issues and arriving at divorce ‘took a long time.’
A source previously told PageSix that the imminent divorce was a ‘badly kept secret’ in Hollywood for months.
It was also shared earlier this week that Reese is ‘upset’ over the marriage ending.
Reese and Jim wed in March 2011 and soon after welcomed their son Tennessee.
The Big Little Lies actress and the talent agent’s split announcement read: ‘We have some personal news to share … It is with a great deal of care and consideration that we have made the difficult decision to divorce.
‘We have enjoyed so many wonderful years together and are moving forward with deep love, kindness and mutual respect for everything we have created together.
‘Our biggest priority is our son and our entire family as we navigate this next chapter.
‘These matters are never easy and are extremely personal. We truly appreciate everyone’s respect for our family’s privacy at this time.’
But there is no mess: ‘There is no drama,’ insisted People’s insider. ‘They love [their son] Tennessee and this is their focus. They will continue to co-parent amicably.’

Reese recently discussed her first divorce from Cruel Intentions co-star Ryan Phillippe.
Speaking to Harper’s Bazaar in July, Reese said she felt very ‘out of control’ when her first divorce went public.
‘When I was divorced before, the tabloid media got to tell people how I was feeling or how I was processing, and it felt very out of control,’ Reese told the publication.
But this go around, the Hollywood star feels that she’s able to be more ‘authentic’ as she navigates this ‘vulnerable time’ in her life.
‘To be able to talk to people directly about what’s going on in my life and just share it in the way that I share great professional experiences or personal experiences, it feels much more authentic to be able to say things in my own voice and not let somebody else control what’s happening,’ Reese explained.
Despite going through a divorce a source close to The Last Thing He Told Me producer told People in April that she has ‘no regrets’ about ending the union and is ‘doing much better now.’
